Bu aydınlatma metni, 6698 sayılı Kişisel Verilerin Korunması Kanununun 10 uncu maddesi ile Aydınlatma Yükümlülüğünün Yerine Getirilmesinde Uyulacak Usul ve Esaslar Hakkında Tebliğ kapsamında veri sorumlusu sıfatıyla Türkiye Barolar Birliği tarafından hazırlanmıştır.

Türkiye Barolar Birliğince, eğitime gelen katılımcıların çalışma ve haberleşme kapsamında ad, soyad, T.C. kimlik no, adres ve iletişim bilgileri, kamera kaydı ve Fotoğraf çekimi İletim iletişim ve Eğitime katılma süreçlerinin yönetilmesi amacıyla işlenmektedir.

Söz konusu kişisel veriler; 1136 sayılı Avukatlık Kanunu hukuki sebebine dayalı olarak otomatik yolla işlenmekte olup Ülke içerisine veya Ülke dışına aktarım yapılmayacaktır. Sadece Türkiye Barolar Birliği’nin çatısı altında başka bir birime geçiş yapılarak katılımcıların kişisel bilgileri komisyon veya merkezlere aktarılır.

Kanunun “ilgili kişinin haklarını düzenleyen” 11 inci maddesi kapsamında

a) Kişisel veri işlenip işlenmediğini öğrenme,
b) Kişisel verileri işlenmişse buna ilişkin bilgi talep etme,
c) Kişisel verilerin işlenme amacını ve bunların amacına uygun kullanılıp kullanılmadığını öğrenme,
ç) Yurt içinde veya yurt dışında kişisel verilerin aktarıldığı üçüncü kişileri bilme,
d) Kişisel verilerin eksik veya yanlış işlenmiş olması hâlinde bunların düzeltilmesini isteme,
e) 7 nci maddede öngörülen şartlar çerçevesinde kişisel verilerin silinmesini veya yok edilmesini isteme,
f) (d) ve (e) bentleri uyarınca yapılan işlemlerin, kişisel verilerin aktarıldığı üçüncü kişilere bildirilmesini isteme,
g) İşlenen verilerin münhasıran otomatik sistemler vasıtasıyla analiz edilmesi suretiyle kişinin kendisi aleyhine bir sonucun ortaya çıkmasına itiraz etme,
ğ) Kişisel verilerin kanuna aykırı olarak işlenmesi sebebiyle zarara uğraması hâlinde zararın giderilmesini talep etme taleplerinizi, Veri Sorumlusuna Başvuru Usul ve Esasları Hakkında Tebliğe göre Kişisel Verileri Koruma Kurumuna iletebilirsiniz.

This clarification text has been prepared by the Union of Turkish Bar Associations as the data controller within the scope of Article 10 of the Personal Data Protection Law No. 6698 and the Communiqué on the Procedures and Principles to be Followed in Fulfillment of the Disclosure Obligation.

The Union of Turkish Bar Associations processes the name, surname, ID number, address and contact information, camera recording and photo shooting of the participants who come to the training within the scope of work and communication to manage the communication and participation in the training.

The personal data is processed automatically based on the legal reason of the Attorneyship Law No. 1136 and will not be transferred within or outside the country. Only by transferring to another unit under the roof of the Union of Bar Associations of Turkey, the personal information of the participants is transferred to commissions or centers.

Within the scope of Article 11 of the Law “regulating the rights of the person concerned”, you can submit your requests:

a) To learn whether personal data is being processed,
b) To request information if personal data has been processed,
c) To learn the purpose of processing personal data and whether they are used in accordance with their purpose,
ç) To know the third parties to whom personal data are transferred domestically or abroad,
d) To request correction of personal data in case of incomplete or incorrect processing,
e) To request the deletion or destruction of personal data within the framework of the conditions stipulated in Article 7,
f) To request notification of the transactions made pursuant to subparagraphs (d) and (e) to third parties to whom personal data are transferred,
g) To object to the emergence of a result to the detriment of the person himself/herself by analyzing the processed data exclusively through automated systems,
ğ) In case of damage due to unlawful processing of personal data,
to the Personal Data Protection Authority in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller.
